WAIVER AND RELEASE

Please read the following carefully:

I do hereby acknowledge that I am/We are the parent(s)/guardian(s) of _____________________________________,

a minor child under the age of eighteen (18) years old (the “Minor”), and as such parent(s)/guardian(s) do hereby voluntarily agree to the following on behalf of myself/ourselves, the Minor, our heirs, assigns, personal representatives and estates:

If player is 18 or over,

(Name of Player) ______________________________, (the “Adult”) do hereby voluntarily agree to the following on behalf of myself, my heirs, assigns, personal representatives and estates:

1.Assumption of Risk. I/We have actual knowledge and conscious appreciation of the danger involved in athletic, and football related activities, including but not limited to bodily injuries and/or death that may result to the Minor, or Adult in connection with engaging in such activities while participating in the football events.

2. Consent to Participation. I/We voluntarily consent to the participation of the ___________________

For the 20___  season.

3. Medical Certification. I/We certify that the Minor, or Adult has been examined by a duly licensed physician and found to be in good health and able to participate in all activities, including those related to participating in contact football without restriction.

4. Medical Treatment. I/We authorize the employees, representatives or agents of (Club Center) _________________ to obtain or consent to any necessary treatment or medical care to the Minor, or Adult in the event of a medical emergency or trauma occurring to the Minor, or Adult during the practices or games.

5. Release. In consideration of Minor, or Adult being allowed to participate in the football events, I/We, and on behalf of Minor, or Adult do hereby completely forever release and covenant not to sue OFA, the _____________, and their employees, sub-contractors, agents, affiliates, members, officers, directors, and respective successors and assigns (collectively known as “Releasees”), from any and all present and future claims, causes of action, damages, costs, expenses, and attorneys’ fees for property damage, bodily and personal injury, illnesses, paralysis, and/or death arising out of Minor’s, or Adult’s participation in the practices and games,  (“Claims”), including as a result of any of the Releasee’s ordinary negligence.

6. Indemnification. I/We hereby acknowledge and agree to fully indemnify and hold forever harmless the Releasees against loss from any and all: (i) Claims; (ii) any and all present and future claims, causes of action, damages, costs, expenses, and attorneys’ fees which may hereinafter or at any time be made or brought against Releasees by any person or entity as a result of property damage, bodily and personal injury, illness, paralysis, and/or death to the Minor, or Adult arising out of the Minor’s, or Adult’s participation in the practices and games; and (iii) any and all present and future claims, causes of action, damages, costs, expenses, and attorneys’ fees which may hereinafter or at any time be made or brought against Releases by any person or entity who claims to have been damaged as a result of Minor’s, or Adult’s negligence in connection with the Minor’s, or Adult’s participation in the football events.

7. Media Release. I/We hereby authorize and grant __________________, and their successors and assigns, the irrevocable right and permission to photograph, record, copy, reproduce, broadcast, transmit, and/or exploit throughout the world, by any present or future method or means, the Minor’s, or Adult’s  participation in the football events. In connection with the foregoing, RSLP and Bills, may use and license to others the right to use, reproduce, distribute, exhibit and televise the Minor’s, or Adult’s name, likeness, voice, physical picture, silhouette and other reproductions of the Minor’s, or Adult’s physical likeness and voice (as they may appear in any electronic format, still camera photograph, and or video film), alone, or with others, in whole or in part, including the internet, world wide web, and to authorize others so to do for advertising, publicity, trade, entertainment, education, or otherwise without further permission or compensation, and to secure copyrights and other intellectual property rights, in all such originals, reproductions and prints.

8. Governing Law. I/We hereby agree that this Waiver and Release shall be governed by the laws of the Province of Ontario, without reference to its choice of rules.

9. Authorization. I/We hereby acknowledge that this Waiver and Release, authorization and permission for the Minor, or Adult to participate in the football events, are freely and voluntarily given by the undersigned(s).

We have read this Waiver and Release, fully understand its terms and conditions, and acknowledge that I/We are giving up substantial rights by signing it.
